ADDENDUM TO TRANSFER SECTION 7, FUNDING SECTION 1, AND UNFUNDED MOVES SECTION 1 OF PERMANENT CHANGE OF STATION MEMORANDUM OF UNDERSTANDING DATED 2/10/00
Provisions of the Permanent Change-of-Station (PCS) Memorandum of Understanding dated February 10, 2000, necessitate that the Agency put certain new measures in place in order to ensure compliance and to protect the spirit of the agreement. Those measures include nationwide access to vacancies for all bargaining unit employees, a process governing non-selection, and tracking mechanisms to monitor funded and unfunded moves as well as distribution of PCS funds. Taken together, these measures will provide the vehicle for the proper placement of new hires that begins in earnest in (FY) 2001, and intensifies each year thereafter.
First, we are establishing a quarterly national review and selection process. It's purpose is to offer a fair and proper opportunity for current employees to advance according to their interest and talent before new hires are placed into the system. Since we have already begun the hiring cycle, the time schedule for this year will be modified by necessity as compared to that of years beginning in FY2002 and beyond. For this year, the new process will help to begin a stabilized and orderly migration while meeting our overall yearly staffing need. This process will be standardized at the national level and administered by Air Traffic Resource Management (ATX.)
Regions must advise Budget (ATX300) quarterly of their funded, unfunded to higher levels and 3R requirements for submission to the BRAT, which is the approval authority for these moves. For FY2002 and beyond, the schedule for submission dates due in headquarters is as follows:
October 15 for 1st quarter requirements
January 15 for 2nd quarter requirements
April 15 for 3rd quarter requirements
August 15 for requirements for the balance of the FY.
For FY2001, national review and selection for vacancies will be triggered by the following submission dates:
March 1 for 2nd quarter requirements
May 1 for 3rd quarter requirements
August 15 for requirements for the balance of the FY
Based on information provided by the regions, the Program
Director for Air Traffic Resource Management, ATX-1, or designee
will assume oversight responsibility for the dissemination of all
vacancy announcements nationwide, identification of whether or
not a vacancy is funded, and the setting of appropriate deadlines
throughout the process. The NATCA ATX liaison will act in a
liaison capacity to the entire process.
A selecting official who decides to fill a vacancy with a new hire or reentrant in lieu of an existing CPC must provide the non-selected CPC the information required by the collective bargaining agreement article 42, section 6, within 14 days. Non-selected CPC's not satisfied with the information provided may submit a request for review to the Regional Vice President and Division Manager within 14 days of receipt of the information. The Regional Vice President and Division Manager will review the request and take appropriate action. If no agreement is reached at the regional level, the issue will be elevated to ATX-1 and the ATX NATCA liaison to take appropriate action. If no agreement is reached at the National level the parties are free to pursue whatever course of action is available to them under the CBA and the Federal Service Labor-Management Statute. If it is determined that the selecting official was in error the CPC will be placed at the facility within 60 days whether or not a vacancy still exist. We encourage you to work together and maximize the benefit from our highly trained and experienced workforce. We will jointly review the effectiveness of these measures every 6 months. Based upon this review, either party may reopen and jointly modify provisions within this agreement to ensure the intent of the PCS Memorandum of Understanding dated February 10, 2000 continues to be met. This addendum terminates simultaneously with the PCS MOU dated 2/10/00.
